With the enactment of the 2023 POWR Act, Colorado’s legal definition of harassment has changed. In most states, harassment is generally defined as behavior that is both persistent and severe. However, in Colorado, any offensive conduct rooted in a protected characteristic, such as race or gender, can be considered harassment if a reasonable person sharing that same protected characteristic would perceive it as harassment. Harassment becomes illegal when it is made a requirement for employment or other workplace determinations, or when it adversely affects job performance or leads to the creation of a hostile work environment.

Although Colorado does not have a legal requirement for anti-harassment training, failing to provide harassment prevention training can leave a company without a defense in harassment-related lawsuits.
