In Colorado, however, any offensive behavior based on a protected characteristic, like race or gender, can be harassment if a reasonable person with that same protected characteristic would also think it’s harassment. Harassment becomes unlawful when it becomes a condition of employment or other workplace decisions, like promotion, or if it impacts work performance or creates a hostile work environment.
